2. Terms and conditions of use.

The sale through this website will only be to companies or professionals in the sector, who want to sell or use our products purchased online in their businesses. In no case will the customer be considered a consumer.

Access to the website www.grupoerik.com or placing an order through it, implies acceptance of these conditions of purchase, as well as those contained in the company's Privacy Policy, so if you do not agree with any of these conditions, you must cease using this website.

These conditions, as well as the content, design and organization of the website, may be revised and/or modified at any time. In case of a revision or modification of the conditions, its new wording will be immediately published and will be accessible on the website, being applicable from that moment. To be correctly informed about the conditions that are applicable at all times, the customer must periodically review them. The use of the website, including access by the customers and navigation through it, is free and implies compliance with these conditions, Spanish legislation, good customs and accepted uses in the field of the Internet.

These conditions are applicable to all customers who use the website. However, in the event that in the future new sections are included on the website that provide specific services, GRUPOERIK may include in the same specific conditions, applicable to said sections, either with priority over these conditions, or complementing them.

Although GRUPOERIK aims to provide users with a continuous service through the website, it may be interrupted by circumstances of various kinds. In this case, GRUPOERIK will try to notify its users in advance, whenever possible.

The contract may be formalised, at the choice of the customer, in any of the languages in which the conditions are available on this website.

These conditions will prevail over any prior written or oral agreement that may exist between the parties and may only be repealed by means of subsequent and specific agreements that must be granted in writing.

If the parties have also signed an agreement for the periodic supply of products, these conditions must be integrated into said agreement and will apply unless the parties, expressly and in writing, agree otherwise.

In the event that any of the stipulations of these conditions were declared totally or partially null and void by any court, tribunal of justice or competent administrative body, said nullity will not affect the remaining stipulations, which will retain their validity and binding effect.

The GRUPOERIK website will report its adherence to the corresponding codes of conduct or seals of approval, copies of which may be requested from our customer service through the channels indicated in the eighth section of these conditions.

3. Products offered and purchase procedure.

The products offered by GRUPOERIK are indicated on the website, including detailed information on their characteristics and compatibilities.

The purchase of products on www.grupoerik.co.uk is only available to professionals, who must be previously registered. The registration is conditioned to the customer´s presentation of their IAE or census declaration and its verification by GRUPOERIK.

In the registration process, the customer enters a username and password and they are solely responsible for maintaining the confidentiality of their account and password, and for all actions that may be carried out on their account and/or with their password. The customer is also responsible for immediately informing GRUPOERIK of any unauthorized use of their username and/or password, as well as disconnecting access after each session.

Once the registration process has been completed, the corresponding registration confirmation is sent to the customer by email or by any other means of communication enabled by GRUPOERIK and accepted by the customer, indicating the need for them to send a copy of their census declaration or IAE to the email address customerservice@grupoerik.co.uk so that their account can be validated.

The customer may cancel their registered user account on the website by any of the following means:

Unsubscribing as a registered user will result in the loss of previous discounts or benefits that have been obtained by the user.

There are several order modalities:

  • Products in stock: these are products that are available in the warehouse and will be sent to the customer after the order confirmation.
  • Pre-order products: this is the advance purchase of items, before they are available in the warehouse.
  • Product reservation: this is the reservation of items in the manufacturing process. Normally they are special campaign or perishable products that have limited units.

To know the number of estimated units of the product, the customer can contact customer service. When the products are available, the customer is notified by email, sending a proforma invoice of the order with a validity of 7 calendar days from its issuance, and the customer must proceed to pay for the shipment of the products. If the customer wishes to make changes to the order with a product reservation, they can do so by contacting customer service within a maximum period of 3 working days from being informed of the availability of the products.

The products that are in stock will appear with the add option in the catalogue. Pre-order or reserve products will appear as such with this identification in the catalogue to be added to the shopping basket. Reservations may be made separately or in the same cart together with other order modalities, in which case, the system will automatically separate product reservations from other orders. Multiple reservations are not allowed on the same product, so duplicate reservations will be automatically cancelled.

The procedure for purchasing products at GRUPOERIK is as follows:

In order to access the website's catalogue and purchase products, it is necessary for the customer to register on the website and have their account validated by GRUPOERIK. Once registered, the customer must log in and select the products they wish to purchase by adding them to the shopping basket, clicking on the corresponding icon.

The shopping basket will include the details of the products chosen and the price corresponding to each of them. The price expressed for each product does not include the amount of the corresponding Value Added Tax (VAT) or the amount of shipping costs, processing costs, or customs fees where applicable, whose rates will vary depending on the shipping method selected and the delivery address provided.

To formalize the purchase, it is necessary to complete the customer's personal data, which will be incorporated into the company's database and processed in accordance with the provisions of our Privacy Policy, to process the order. In the event that the shipping address does not match the customer's billing address, it must be indicated in the order address area.

Before formalizing the order, a summary of the order will appear with the identification of the products to be purchased, the shipping details of the order and the total price, with the amount of taxes and shipping costs broken down. In this way, the customer will be able to modify the details of the order before formalizing it by accepting the purchase conditions and clicking on the CONFIRM AND PAY ORDER section.

After completing the purchase process and within a maximum period of 24 hours, an email is sent to the customer confirming the placing of the order, including the order details.

If the customer has not received the order confirmation email, they should check their SPAM box or contact our customer service.

The customer must correctly indicate their personal data to avoid incidents in the processing of the order. In the event that the customer notices any type of error in the order once the purchase process has been completed, they must immediately contact our customer service to correct the error. The customer can contact GRUPOERIK customer service through the telephone or email noted in the eighth section of these conditions.

The shipment of the products and the quantities requested in the order are subject to availability. If once the order has been formalized, there is a lack of stock of any of the products included, GRUPOERIK will contact the customer as soon as possible to communicate this circumstance and, where appropriate, set a new delivery time, and the customer can decide whether to accept it or opt for the cancellation of the order with a refund of the amount paid.

GRUPOERIK may cancel an order if it has indications that it may be fraudulent or that the customer who has placed it is a minor, when it is impossible to deliver the order to the address provided by the customer or in the event of any cause of force majeure beyond the control of GRUPOERIK. Among other causes, we understand that force majeure exists in the following cases: accidents; strikes; terrorist revolts, threats or attacks; fire or explosion; meteorological causes or natural disasters such as a storm, flood, earthquake, sinking, epidemic; or problems unrelated to us in the means of transport or telecommunication systems. In such cases, the amounts that have been paid will be fully reimbursed.

GRUPOERIK will not assume responsibility if the delivery of the product is not carried out because the data provided by the customer is false, inaccurate or incomplete. In these cases, the price of the products will be refunded, but not the shipping costs.

4. Price and payment.

The prices of the products included on the website are shown in pounds sterling and may vary at any time.

Offers are marked and identified as such. Their validity terms are effective as long as they are published. A publication is understood as that which occurs from direct consultation to the servers of GRUPOERIK and not that which can be done through Proxy services or similar, with content stored without direct consultation to the server.

The presented prices are subject to approval by the sales department in relation to each customer. For this, contact us via the email customerservice@grupoerik.co.uk.

All prices listed on the website do not include VAT, the amount of which will be broken down in the purchase process. VAT will be applied at the rate in force at all times and depending on the specific article in question. Any change that occurs in the VAT rate will be automatically applied to the prices of the products on sale. There is also no provision for customs or excise duties, if any.

The price of the items will be as indicated on our website. If we find an error in the price of any of the items in an order, the customer will be informed as soon as possible, giving them the option to reconfirm their order with the correct price or cancel it at no cost. If it is impossible to contact the customer, the order will be considered cancelled and the amounts received will be fully reimbursed. GRUPOERIK will not be obliged to supply any item purchased with an incorrect lower price if the error in the price is obvious and unequivocal, having been easily recognized by the customer as an incorrect price.

The amount of the shipping costs is calculated prior to the customer´s order confirmation, depending on the chosen shipping method and the delivery address provided. This amount is broken down in the purchase summary.

The products offered through the website are available for national and international shipments, depending on the conditions of each country. When changing countries, shipping methods and other terms of sale are updated.

However, in general terms, home deliveries within the UK will be free of charge if the purchase is at least £150 excluding tax.

Shipping costs can be modified at any time without prior notice. This change will be applicable from the moment the modification is included in these conditions. In any case, the shipping costs that appear at the time of placing the order will be valid. Shipments to countries outside the European Union may occasionally incur customs and/or tariff duties or other surcharges that may apply, which vary from country to country and which GRUPOERIK has no control, and it is not possible to anticipate their amount. These amounts will be borne by the customer, so it is advisable to contact the corresponding Customs Office before placing the order for information on possible import restrictions that apply to certain products. GRUPOERIK will try to provide the customer with all the necessary documentation to process the customs approval.

Any ongoing discount or promotion can be applied directly to the customer's order, once the requirements to access the discount or promotion have been verified.

When making the purchase, the customer will receive the paper invoice along with the order.

Payments made by credit or debit card (Visa, Mastercard, American Express, JCB, Diners and Unionpay) are accepted, which will be made through the REDSYS payment gateway, or by wire transfer.

If the payment option by wire transfer is chosen, the data will be provided for executing it along with the order confirmation. Payments by wire transfer must be made to the following account, indicating the order number in the concept field:

Once the payment has been made, proof of the wire transfer must be sent to the email address customerservice@grupoerik.co.uk. Orders in which the price is paid by wire transfer are conditioned on the execution of said payment, which may be delayed up to four business days with the right to reserve the products purchased. Once this period has elapsed without the transfer having been made, GRUPOERIK may proceed with the cancellation of the order.

5. Delivery of products.

The products purchased through this website will be made available at the location indicated for this purpose. The risks that may arise from the products shall be borne by the customer from the moment of delivery. It will be understood that the order has been delivered at the time the buyer, or an indicated third party, signs the receipt of the order at the agreed delivery address.

The shipment of the products will be made through a delivery company within the period indicated on the website, according to the selected shipping method and the delivery address provided.

The delivery time for products in stock is between 2 to 4 working days (Monday to Friday) for shipments within mainland UK. The shipment of the products in reservation mode will be subject to the availability date indicated for said items. In international shipments or outside mainland UK, delivery times may be longer and will be indicated in the purchase process, depending on the destination.

Delivery dates or deadlines shall be deemed approximate. The delivery time may vary in case of unforeseen circumstances, in which case its non-compliance will not result in the cancellation of the order or the payment of penalties and/or compensation for damages and/or interest. In any case, the maximum delivery time for the products is thirty (30) calendar days from the date of order confirmation.

6. Returns.

Purchases made on this website do not have the right to return, except in those cases in which the return is due to a circumstance unrelated to the customer.

Specifically, GRUPOERIK recognizes the right to return the items purchased, assuming the shipping costs, in the following cases:

  • The products received do not correspond to the order placed.
  • The products delivered have defects or faults linked to the product itself or caused by an incident during the distribution process.

In these cases, the customer must immediately inform customer service via email or telephone, within a maximum period of 4 days from receipt of the goods, providing the invoice number, reference and quantity, images or videos of the item and with its original packaging.

In the event that the final consumer manifests to the customer the existence of any defect or hidden defect in the product, the customer must notify Grupo Erik within a maximum period of 7 days from the consumer's communication. Grupo Erik undertakes to evaluate the situation and analyse if the product warranty may be applied, to take the appropriate measures to solve the problem and to return to the customer, if appropriate, the amounts to be paid to the final consumer.

Within 2 working days after the claim, GRUPOERIK must contact the customer and inform them of the validity of said claim or request some justification of the reasons for the return.

Once the return has been accepted, the customer must send the products following the instructions provided by GRUPOERIK. The payment will be made within 30 days once the condition of the products has been verified.

If there is any discrepancy or problem with the condition of the packaging of the order or the conditions of the products at the time of delivery, the nature of said discrepancy or problem must be reflected in the delivery note and signed. The incident must be communicated by the customer to GRUPOERIK within a maximum period of 48 hours. Otherwise, GRUPOERIK will not be responsible for the state in which the goods arrive.

In case of not respecting the indicated procedure and the deadlines stipulated above, the buyer may not make any claim for non-conformity or alleged defect of the products delivered. These products shall be deemed to be in accordance with the order and free from any defect.

Exceptionally, a return period for perishable items is established for school planners, from September to November, and annual calendars, planners and annual agendas, from January to April, for those orders placed in the year in question. The amount to be returned is 10% of the perishable product of the order, by credit to be deducted on a subsequent purchase (balance in favour of the customer´s account). The direct costs of this type of return will be borne by the customer.

No refund will be made for products that are not in the same condition in which they were delivered or that are damaged. Items must be returned in their original packaging, including all accessories and components.

Some of the products marketed on our website may have characteristics associated with the materials used in their manufacture, which may imply some variation in the texture or colour of the products, which cannot be considered a lack of conformity.

7. Transfer of rights and obligations.

The customer may not assign or transfer to third parties the rights or obligations derived from the contracts signed with GRUPOERIK without having obtained prior written consent.

The waiver by GRUPOERIK of any right or action derived from these conditions of purchase, will not imply in any case its waiver of other rights or actions, unless expressly communicated in writing.

You are a business, so these terms of use, their subject matter, and their formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.
